TERMS AND CONDITIONS OF USE
GENERAL INFORMATION
These Terms and Conditions govern access to, registration for and use of the services offered through the IDLING Platform.
The owner and provider of the service is Pedro Jesús Parada Avendaño, NIF 03129787Q, hereinafter “the Controller”
For queries related to the operation of the service, the User may write to support@idlingapp.com.
For matters relating to privacy and data protection, they may contact privacy@idlingapp.com.
PURPOSE AND ACCEPTANCE OF THE TERMS
These Terms and Conditions govern registration for, access to and use of IDLING, a dating platform in beta that allows users to create profiles, receive compatibility suggestions, establish connections and communicate with other users, as well as use the other functionalities available at any time.
Creating an account and using the Platform imply acceptance of these Terms. Before registering, the User must read and accept them through the mechanism provided.
The Privacy Policy is provided separately and informs about the processing of personal data.
If the User does not agree with these Terms, they must not create an account or use the Platform.
BETA ACCESS AND FREE OF CHARGE
IDLING is currently offered as a free app beta. The beta phase means that certain functionalities may be under development, modified, limited, suspended or present incidents typical of a service in evolution.
The Controller will endeavour to inform of relevant changes that affect use of the service. The beta or free character does not limit the rights that applicable law recognises for the User.
If paid services are incorporated in the future, the User will be informed in advance of their characteristics, price and conditions, and must accept the corresponding contracting conditions before making any payment.
AGE REQUIREMENTS, CAPACITY AND TERRITORIAL AVAILABILITY
The Platform is intended exclusively for persons aged 18 or over who have sufficient legal capacity to accept these Terms.
The User declares that they may lawfully use a dating service in the country or territory from which they access.
Availability of IDLING in a territory does not imply that all its functionalities are permitted by local law. The Controller may limit or suspend access from certain territories when necessary to comply with legal obligations or manage relevant risks.
The Controller may request reasonable checks to verify age, identity or fulfilment of access requirements.
REGISTRATION, ACCOUNT AND CREDENTIALS
To use the main functionalities of IDLING, the User must create an account and complete the information required in the registration process.
The User undertakes to:
Provide true, accurate, up-to-date information corresponding to their own person.
Keep their account and profile information up to date.
Safeguard their credentials and not share them with third parties.
Immediately report any unauthorised access or suspicion of improper use to support@idlingapp.com.
Not create false accounts, impersonate identities or use another person’s account.
The User will be responsible for use of their account when such use is attributable to them.
The Controller may adopt protective measures when it detects anomalous access, fraud, impersonation or security risks.
PROFILE CREATION AND VERIFICATION
The User must complete the data and content necessary to create their profile and access certain functionalities. The Platform will indicate which information is necessary and which is optional.
In order to strengthen profile authenticity and hinder fraudulent use, IDLING may check that the presentation video corresponds to the same person appearing in the profile photograph and that the images provided meet the basic requirements established on the Platform.
The User must provide only their own, current and truthful photographs, videos, audio and data.
Passing a check does not constitute an absolute guarantee as to a person’s identity, background, intentions or future conduct.
RECOMMENDATIONS, MATCHING AND CONNECTIONS
IDLING uses profile information, preferences, location and other compatibility criteria to rank and display potentially compatible profiles through a system of rules and scores.
IDLING offers suggestions on a limited and progressive basis. Each suggestion may remain available for a determined period and the number of suggestions or active slots may be limited in accordance with the Platform’s operation.
Suggestions are indicative and do not guarantee compatibility, affinity, reciprocity or the success of a relationship. It is always for each User to decide whether to establish, maintain or end a connection.
The Controller may adjust the criteria and operation of the system to improve the service, prevent abuse or correct incidents, without arbitrarily altering the User’s rights.
COMMUNICATIONS AND CHAT BETWEEN USERS
When a connection exists, users may communicate through the available functionalities, which may include text messages, photographs and voice notes.
The User must use these channels in a respectful and lawful manner.
They may not send unsolicited content for advertising purposes, intimidating messages, threats, unlawful content or communications intended to obtain data fraudulently or cause harm to other people.
The Controller does not permanently supervise all private conversations. However, it may access information strictly necessary when there is a report, a security incident, a legal obligation or a moderation need, in accordance with the Privacy Policy and applicable law.
CONDUCT RULES
The User undertakes to maintain respectful conduct and to use IDLING exclusively for personal purposes related to the purpose of the Platform.
It is prohibited to:
Harass, threaten, intimidate, discriminate or incite hatred or violence.
Publish or transmit unlawful, misleading, offensive content or content that infringes third-party rights.
Engage in spam, unauthorised advertising, commercial solicitation or mass data extraction.
Request money, credentials, financial information or personal data fraudulently.
Use bots, automated techniques or mechanisms intended to alter, overload or circumvent Platform security.
Carry out reverse engineering activities outside the cases permitted by applicable law.
Create false profiles, impersonate other people or manipulate verification, recommendation, reporting or moderation systems.
Use the Platform for illegal activities or activities incompatible with the safety and dignity of other users.
CONTENT PROVIDED BY THE USER
The User retains the rights they hold over the content they incorporate into the Platform.
By publishing or sending content, the User grants the Controller a non-exclusive, royalty-free licence limited to the time and scope necessary to host it, reproduce it technically, display it to the corresponding recipients and use it to provide, maintain and protect the service.
This licence does not authorise independent sale of the content or its use for purposes unrelated to the Platform.
The User warrants that they have the necessary rights and authorisations over the content they provide and that it does not infringe the law, privacy, honour, image rights, intellectual property or other third-party rights.
Users may not copy, record, download, disseminate or use outside IDLING the photographs, videos, audio, messages or other content of third parties without authorisation or without a legal basis that permits it.
The Controller may remove or limit access to content when there are reasonable indications of unlawfulness, breach of these Terms, risk to third parties or a request from a competent authority.
REPORTS, MODERATION AND MEASURES AGAINST BREACHES
Users may report profiles, content or conduct that they consider contrary to these Terms or that may create a risk for the community.
The Controller may review the available information and adopt proportionate measures, such as:
Warning the User.
Removing or limiting the visibility of certain content.
Temporarily limiting some functionalities.
Temporarily reducing access to new connections.
Suspending the account.
Cancelling the account in the most serious cases.
Measures will be determined having regard to the seriousness, repetition, context and risk of the conduct.
When the decision is based on a report or an automated signal, additional checks may be carried out before applying relevant consequences, unless it is necessary to act immediately to protect users or comply with a legal obligation.
The affected User may request review of a measure by writing to support@idlingapp.com and providing the information they consider relevant.
The Controller will communicate the decision adopted and its reasons to the extent required by applicable law and always where compatible with the protection of third parties and the security of the service.
RESPECTFUL COMMUNICATION AND ENDING CONNECTIONS
IDLING promotes respectful communication among users.
When a connection is no longer of interest, it is recommended to end it clearly using the options available on the Platform.
The Platform may record connection exits, reports related to repeated interruptions of communication and other indicators linked to the security and quality of the service.
These elements may be taken into account to apply proportionate measures regarding access to new connections, always with the possibility of review when the measure has relevant effects for the User.
The applicable operational criteria and concrete consequences will be shown clearly on the Platform before they can affect the User.
No penalties will be applied merely because a person freely decides to end a relationship or stop communicating when there are reasons of safety, wellbeing or any other legitimate cause.
Application of measures linked to reports for interruption of communication will be subject to criteria of proportionality, repetition and context. An isolated report will not automatically determine suspension or penalisation of an account.
IN-PERSON MEETINGS AND SAFETY
IDLING facilitates introduction and communication between users, but does not participate in personal relationships or control people’s conduct outside the Platform.
The User must act with prudence before and during any in-person meeting, protect their personal information and report through the available channels any abusive, fraudulent or dangerous conduct.
Profile verification is not equivalent to a full background check and does not guarantee the identity, honesty, compatibility or behaviour of another User.
The Controller does not carry out full criminal background checks in the beta phase, unless expressly informed otherwise.
Urgent situations or those involving immediate risk must be reported to emergency services or the competent authorities.
Reports related to the Platform may be sent through the enabled functions or via safety@idlingapp.com.
SUSPENSION, PAUSE, DELETION AND ACCOUNT REMOVAL
The User may pause or delete their account using the options available on the Platform.
Pausing limits visibility or certain functionalities, but is not equivalent to deletion of the data associated with the account.
The Controller may limit, suspend or cancel an account when any of the following circumstances apply:
Breach of these Terms.
Fraud, impersonation or manipulation of the Platform.
Risk to other people or to the security of the service.
Legal obligation or request from a competent authority.
Impossibility of continuing to provide the service safely.
Serious or repeated breaches of the conduct rules.
Except in urgent or legally restricted cases, the Controller will endeavour to inform the User of the measure adopted and, where appropriate, offer a review channel.
Deletion and retention of personal data will be governed by the Privacy Policy.
AVAILABILITY, MAINTENANCE AND BETA CHANGES
The Controller will make reasonable efforts to keep the Platform available and secure, but does not guarantee uninterrupted availability or the total absence of errors.
Maintenance tasks, updates, tests, modifications or withdrawals of functionalities may be carried out.
When a change relevantly affects use of the service, the User will be informed by appropriate means.
The Controller may end the beta or the service for technical, organisational, legal or viability reasons, informing with reasonable advance notice when circumstances permit and facilitating, where applicable, the options available to obtain a copy of the data.
LIABILITY
The Controller will be liable in accordance with applicable law.
Nothing in these Terms excludes or limits liabilities that legally cannot be excluded or limited, nor the non-waivable rights of consumers and users.
The Controller does not guarantee that suggestions will produce a relationship, that users will respond or maintain communication, or that information provided by third parties is always accurate, without prejudice to the verification and moderation measures applied.
The Controller will not be liable for damage arising from use contrary to these Terms, from acts exclusively attributable to the User or to third parties, or from circumstances beyond its reasonable control, always within the limits permitted by law.
The User will be liable for the direct damage they cause through an unlawful act or a culpable breach of these Terms, without prejudice to the guarantees and limits provided by applicable law.
LINKS AND THIRD-PARTY SERVICES
The Platform may include links or integrations with websites, app stores, social networks and third-party services.
Use of those services may be subject to their own terms of use and privacy policies.
The Controller does not control the content or actions of independent external services and is not responsible for them, except in those cases where applicable law provides otherwise.
INTELLECTUAL AND INDUSTRIAL PROPERTY
The Platform, its design, software, interfaces, trademarks, logos, texts, graphics and other proprietary elements are owned by the Controller or by third parties who have authorised their use and are protected by intellectual and industrial property law.
Use of IDLING does not grant the User rights over those elements, except the limited, personal, non-exclusive, non-transferable and revocable authorisation necessary to use the service in accordance with these Terms.
It is not permitted to copy, modify, distribute, exploit, reverse engineer or use Platform elements outside the cases authorised by law or by the Controller.
These limitations will not affect the rights that applicable legislation recognises for the User nor acts that cannot be contractually restricted.
DATA PROTECTION AND PRIVACY
Processing of personal data arising from use of IDLING is governed by the Privacy Policy.
The Privacy Policy informs, among other aspects, about the purposes and legal bases of processing, the categories of personal data, recipients, possible international transfers, retention periods and the User’s rights.
Acceptance of these Terms does not replace the specific consents that must be requested for optional or specially protected processing.
MODIFICATION OF THE TERMS
The Controller may update these Terms to adapt them to legal, technical, organisational or functional changes.
Relevant modifications will be communicated through the Platform or by email before they take effect, when required.
If the change requires a new acceptance, the User must give it in order to continue using the affected functionalities.
The applicable version will be the one published and accepted by the User, without prejudice to mandatory rules that apply.
APPLICABLE LAW AND JURISDICTION
These Terms will be governed by Spanish law, without prejudice to mandatory rules and consumer protection that may apply in the country of the User’s habitual residence.
Any dispute will be submitted to the courts and tribunals that are competent under applicable law.
No territorial submission is imposed on the consumer User that limits the rights to which they are legally entitled.
GENERAL PROVISIONS
If any clause of these Terms is declared invalid, illegal or unenforceable, the remaining clauses will retain their validity to the extent permitted by law.
Failure by the Controller to exercise a right does not constitute a waiver.
The Controller may transfer management or ownership of the service in the context of a reorganisation, incorporation of a company, financing, merger, acquisition or transfer of the project.
In such cases, the User will be informed when necessary and the transfer will not imply a reduction of the rights recognised by law or contract.
The User may not assign their account or contractual position to third parties without the Controller’s authorisation.
